Under Oklahoma law, either spouse is eligible for support. You simply have to prove a need for the support and that your spouse has the ability to pay. Typically, alimony is awarded in the form of a money judgment paid in installments. However, alimony may also come from real or personal property, and it can be payable either in a lump sum or monthly as the court rules.

In Oklahoma, there is no formula or calculator to determine the amount of spousal support anyone is entitled to receive. In addition, there is no set rule on how long alimony payments will have to be made. Both are entirely at the judge’s discretion and made on a case-by-case basis. Typically, the court will take into consideration factors such as the duration of the marriage; age, income and earning capacity of the parties; and anything else the judge determines is relevant (except for fault – that is not a determining factor in Oklahoma).
